These terms govern your use of humanyouare.org and your membership in the circles ("humanyouare" and "The Elders Circle"), operated from Mexico by [YOUR FULL LEGAL NAME] ("we," "us," "Jarek"). By using the site, joining the email list, applying, or becoming a member, you agree to them.
The circles are peer connection spaces: small weekly gatherings, held over Zoom, where members listen and are listened to.
The circles are not therapy, counseling, medical care, or mental health treatment, and are not a substitute for any of them. Jarek and any facilitators are not acting as licensed therapists, physicians, or medical providers within the circles. If you are in crisis, experiencing thoughts of harming yourself or others, or need clinical care, please contact local emergency services or a licensed professional. Membership may be paused or declined where we believe, in good faith, that a circle is not a safe or adequate setting for someone's current needs.
The foundation of the circles is a mutual promise: what's said in the circle stays in the circle. As a member you agree to:
You may speak about your own experience outside the circle, so long as no one else's identity or story is revealed. We hold this obligation too: sessions are not recorded by us — unless a recording or special exercise is clearly announced to everyone before the call, in which case taking part in that portion is optional — and we don't share what you disclose. Confidentiality has legal limits — where disclosure is required by law, or where we reasonably believe there is imminent risk of serious harm to you or another person.
To keep the room safe for everyone, members agree to:
We may pause or end a membership for breaches of confidentiality or conduct. For a serious breach (such as recording a session), termination may be immediate; otherwise we'll talk with you first, as adults. If we end your membership without cause on our side, we'll refund the unused portion of your month.
Participation is voluntary, including in each moment — you're never required to share anything. You're responsible for your own choices, disclosures, and wellbeing in and around the circles. Other members' words are their own; we don't endorse, verify, or take responsibility for what members say.
Sessions run on Zoom and payments run through Stripe; their terms and privacy policies apply to your use of their services. We're not responsible for outages or failures of third-party services, though we'll always work to reschedule affected sessions.
The site and circles are provided "as is." We don't promise any particular outcome — connection is a practice, not a product. To the maximum extent permitted by applicable law: we are not liable for indirect, incidental, or consequential damages arising from the site or the circles, and our total liability for any claim is limited to the amounts you paid us in the three months before the claim arose. Nothing in these terms limits liability that cannot be limited under the law of your place of residence, or your non-waivable rights as a consumer (including, for residents of Mexico, rights under the Ley Federal de Protección al Consumidor).
These terms are governed by the laws of Mexico. Disputes will be resolved in the competent courts of [CITY, STATE], Mexico, except where mandatory consumer law gives you the right to bring a claim where you live. Before any formal dispute, both sides agree to try first what the circles are built on: a direct, honest conversation.
We may update these terms. Material changes will be posted here with a new date and, for members, notified by email at least 15 days before taking effect. If you don't agree with a change, you may cancel before it takes effect.
